§ 1 General provisions

These Terms & Conditions (the “Terms”) govern the provision of services by electronic means under the Solopreneur web application (the “Service”) and are issued on the basis of Article 8 of the Polish Act of 18 July 2002 on the provision of services by electronic means (Dz.U. 2002 No. 144 item 1204, as amended) and of Regulation (EU) 2022/2065 (Digital Services Act, “DSA”).

§ 2 Service provider

The provider of the Service is Jakub Byliński Development, with its registered office at os. Osiedle Tysiąclecia 4A/4, 73-110 Stargard, Poland, NIP 8542455178, REGON 542043722 (the “Provider”).

The Provider can be contacted:

Electronic point of contact for the authorities of Member States, the European Commission and the European Board for Digital Services (art. 11 DSA): scheedo.dsa.admin@gmail.com. Communications may be submitted in Polish or in English.

§ 3 Definitions

  • User - a natural person, legal person, or organisational unit without legal personality using the Service;
  • Consumer - a User who is a natural person concluding an agreement with the Provider for purposes not directly related to their business or professional activity;
  • Account - the individual panel of the User in the Service;
  • Subscription - a paid plan giving access to the functionality of the Service for a specified period;
  • Connected Account - the User’s Stripe account connected to the Service via Stripe Connect.

§ 4 Scope of the Service

The Service provides analytics, dashboards and email notifications related to the User’s subscription business data imported from the User’s Connected Account (in particular: MRR, churn, cohorts, forecasting, dunning, weekly digest, benchmarks, VAT invoicing).

Access to the Service is provided on a Software-as-a-Service basis from the Provider’s infrastructure. The Service is provided 24/7, save for periods of maintenance, force majeure, or causes attributable to third parties (e.g. Supabase, Stripe, Vercel).

§ 5 Account and conclusion of the agreement

An Account is created by completing the registration form and accepting these Terms. The agreement for the provision of services by electronic means is concluded for an indefinite period upon successful creation of the Account.

A 14-day free trial is granted automatically upon account creation. Continued use of paid functionality after the trial requires an active Subscription.

§ 6 Subscriptions and payment

Subscription fees are listed on the Solopreneur website. Payments are processed by Stripe Payments Europe, Ltd. and are subject to Stripe’s terms. Subscriptions renew automatically for successive periods unless cancelled at least before the end of the current period.

The Provider issues VAT invoices via Stripe Invoicing on the basis of billing data provided by the User. The User is responsible for the accuracy of such data.

§ 7 Consumer right of withdrawal

A Consumer has the right to withdraw from the agreement within 14 days of its conclusion, without giving any reason, by sending a statement to jakub.bylinski@gmail.com.

In accordance with art. 38 sec. 13 of the Polish Consumer Rights Act, the right of withdrawal does not apply to agreements for the supply of digital content not on a tangible medium where performance has begun with the prior express consent of the Consumer before the expiry of the withdrawal period and the Consumer has been informed of the loss of the right of withdrawal. By starting to use paid functionality before the expiry of the 14-day period, the Consumer expresses such consent and acknowledges such loss.

§ 8 Obligations of the User and prohibited content

The User undertakes not to use the Service in a manner that:

  • infringes the law, the rights of third parties, or good morals;
  • introduces illegal content within the meaning of art. 3 lit. h DSA;
  • disrupts the operation of the Service or attempts to circumvent its security;
  • uses the Service to send unsolicited commercial communications.

§ 9 Notice of illegal content (art. 16 DSA)

Any person may submit a notice of allegedly illegal content present in the Service by sending it to scheedo.dsa.admin@gmail.com. The notice should contain at least:

  • a sufficiently substantiated explanation of the reasons why the content is considered illegal;
  • the exact electronic location of the content (e.g. URL);
  • the name and email address of the person submitting the notice (except for notices concerning offences referred to in articles 3–7 of Directive 2011/93/EU);
  • a statement of good faith that the information and allegations contained in the notice are accurate and complete.

The Provider shall confirm receipt of the notice without undue delay and shall notify the submitting party of the decision taken, together with information on the available redress possibilities.

§ 10 Complaints

Complaints regarding the Service may be submitted by email to jakub.bylinski@gmail.com. The Provider shall examine each complaint within 14 days of receipt and shall inform the User of the outcome by the same channel.

§ 11 Liability

To the maximum extent permitted by applicable law, the Provider’s liability towards Users who are not Consumers is limited to direct damages, up to the value of fees paid by such User in the 12 months preceding the event giving rise to liability. Nothing in these Terms limits the rights of Consumers under mandatory provisions of law.

§ 12 Personal data

The processing of personal data is described in the Privacy Policy, available at /legal/privacy. The Provider acts as the controller within the meaning of art. 4(7) GDPR with respect to data described therein.

§ 13 Out-of-court dispute resolution

A Consumer may use out-of-court mechanisms for handling complaints and pursuing claims, including the EU online dispute resolution platform available at https://ec.europa.eu/consumers/odr.

§ 14 Amendments

The Provider may amend these Terms for important reasons, in particular: changes in law, changes in the scope of the Service, or changes in the manner of providing the Service. Users will be informed of amendments by email or via in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the new Terms.

§ 15 Governing law and jurisdiction

These Terms are governed by Polish law. Disputes shall be settled by the court having jurisdiction under generally applicable provisions; this does not exclude the mandatory jurisdictional rules protecting Consumers.
